Conditions of participation

This is how it works:


Preamble
These Terms and Conditions of Participation govern the Self-Recruiting System („SRS“) of ZAG Menschen & Perspektiven („ZAG“) for temporary staff as defined below. These Terms and Conditions of Participation govern the conditions for the accrual of a bonus upon successful placement (recruitment) of a new ZAG employee by the participant.

  1. Scope of application and terms
    1.1 Participants: Only temporary staff employed by ZAG, i.e. employees who are in an employment relationship with ZAG for the purpose of temporary employment (hereinafter referred to as „Participants“), are eligible to participate.
    1.2 Recommended: Persons (hereinafter referred to as „candidates“) who have been recommended by participants and who enter into an employment relationship with ZAG.
    1.3 Levels: The bonus levels correspond to levels B-F according to the SRS product description (A = recommending employee; B-F subordinate). A level is only created if the candidate at the preceding level can be shown to have effectively recruited another candidate, i.e. an effective employment relationship is established with ZAG following a recommendation.
  2. Participation requirements
    2.1 Participation is only possible for employees of ZAG who have not given notice at the time of the recommendation.
    2.2 The recommended candidate has not been employed by a ZAG branch in the 6 months prior to the recommendation.
    2.3 The recommended candidate must have been working productively for ZAG for at least two weeks.
  3. Proof of causality
    3.1 Participants must provide reasonable proof of the recommendation and its causality (e.g. mention in application, refer ID, e-mail/portal form).
    3.2 ZAG shall check the requirements without delay and inform the participant of the result.
  4. Premiums and due date
    4.1 Premium levels and amounts:
    a) Level B: € 150 gross;
    b) Level C: € 100 gross;
    c) Level D: € 75 gross;
    d) Level E: € 50 gross;
    e) Level F: € 25 gross.
    4.2 Origin:
    a) Level B is created when the recommended candidate is hired and fulfils point 2. b) Levels C-F are only created when the candidate at the previous level effectively recruits another candidate who fulfils the requirements of point 2.
    4.3 Maturity:
    Payment will only be made non-cash per level with the next payroll after a positive audit notification, provided that all documents have been submitted.
    4.4 Inventory protection:
    Premium claims that have already arisen remain unaffected by subsequent programme changes or cancellations.
  5. Reasons for exclusion
    5.1 Multiple recommendations: The first registered recommendation with a traceable time stamp is decisive.
    5.2 Obvious misuse (e.g. bogus registrations): ZAG may exclude participation and also the payment of rewards for good cause, in particular in the event of obvious misuse, whereby these reasons shall be communicated to the participant at least in text form.
  6. Obligations of the participants
    6.1 Truthful information
    The participant is obliged to observe the obligations under labour law and co-determination/compliance rules and to provide truthful information.
    6.2 In addition, the Participant shall refrain from unfair solicitation of ZAG's customers and/or unlawful procurement of addresses.
  7. Term and cancellation
    7.1 The SRS is offered for an indefinite period.
    7.2 ZAG may terminate the SRS with a notice period of [4] weeks in text form or adjust it by means of a change notification in accordance with Section 9. Any claims of the participant that have already arisen remain unaffected.
    7.3 Individual participation ends with the termination of the employment relationship.
  8. Liability
    8.1 ZAG shall be liable without limitation in the event of intent and gross negligence as well as for damages resulting from injury to life, limb or health.
    8.2 In the event of slight negligence, ZAG shall only be liable in the event of a breach of material contractual obligations and in this case limited to the foreseeable damage typical for the contract. Essential contractual obligations (also cardinal obligations) are the central obligations of a contract. Their fulfilment is essential for the proper execution of the contract, which is why the contractual partner may rely on their compliance.
  9. Changes to the conditions of participation
    9.1 ZAG may amend these terms and conditions if a) mandatory statutory or regulatory requirements make this necessary, or b) this is necessary to close unintended regulatory gaps that significantly impair implementation, or c) functional adjustments are made to the SRS without impairing the equivalence ratio.
    9.2 Changes may not shift the contractual balance to the detriment of the participants; premium claims that have already arisen remain unaffected.
  10. Choice of law and place of jurisdiction
    German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
  11. Final provisions
    Invalid provisions shall not affect the validity of the remaining provisions. Individual agreements between ZAG and the participant shall take precedence.
